The investigation has taken a serious turn in recent days, raising the clear possibility that whether Mueller finds wrongdoing or not, a period of political stress and upheaval is inevitable. But there is no hard-and-fast rule requiring a potential defendant to be advised of an investigation and his or her role in it.

At the president's urging, he has been on the offensive, casting doubt on Comey's character and raising questions about whether the former Federal Bureau of Investigation director inappropriately disclosed sensitive material. When Robert Mueller was appointed special counsel to investigate possible collusion between Russian Federation and the Trump campaign, and any related matters that may spring from that, Trump was then technically under investigation, being the "Trump" in the Trump campaign.

Cuomo also challenged Sekulow's claim that the president was above legal reproach for obstruction of justice in his firing of Comey, noting that the question had never before been litigated.
